Terms of Service

Last updated: February 1, 2026. These terms govern your use of MyAluxTech's website and services.

1. Acceptance of terms

By accessing or using the MyAluxTech website ( myaluxtech.com ) or engaging any of our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use our website or services. We may update these Terms from time to time, and continued use after changes constitutes acceptance of the updated Terms.

2. Our services

MyAluxTech provides complete business solutions including but not limited to: web application development, mobile application development, website development, AI integration and LLM solutions, automation and workflow services, social media management, virtual assistant services, BPO and back-office services, and cloud/DevOps services. The specific scope, deliverables, timeline, and fees of any engagement are defined in a separate service agreement or statement of work signed by both parties.

3. Quotes, proposals, and scope

Quotes and proposals provided by MyAluxTech are valid for 30 days from the date of issue unless otherwise stated. Every engagement is scoped in a formal proposal and confirmed in a signed service agreement or statement of work. We reserve the right to adjust scope or fees for changes requested after sign-off, additional revisions, or third-party costs (e.g. hosting, ad spend) that were not included in the original scope.

4. Payment terms

For one-time projects: a 50% deposit is due upon signing, with the balance due per the milestones defined in the service agreement. For monthly retainers: payment is due in advance on the 1st of each billing cycle. Invoices are due within 14 days unless otherwise stated. Late payments may incur a 1.5% monthly interest charge. We accept bank transfer, credit card, and other methods specified on the invoice.

5. Money-back guarantee

We offer a 14-day money-back guarantee on most one-time projects and a 30-day guarantee on larger engagements — the exact guarantee window is specified in your service agreement. If you're not satisfied within this period, we'll refund the deposit minus the value of work already delivered. Monthly retainers can be cancelled anytime with 30 days' notice — no long-term contracts. The guarantee does not cover third-party costs (e.g. ad spend, hosting fees) or services where deliverables have already been completed and accepted.

6. Client responsibilities

To enable us to deliver our services, you agree to:

  • Provide timely access to required systems, accounts, and materials.
  • Respond to review requests and approvals within a reasonable timeframe (typically 3 business days).
  • Provide accurate and complete information for project requirements.
  • Ensure you have the rights to any content, branding, or data you provide to us.
  • Make timely payments per the agreed schedule.

Delays in client feedback, access, or approvals may affect the project timeline. We're not responsible for delays caused by client-side factors beyond our control.

7. Intellectual property

Upon full payment of all amounts due, ownership of custom deliverables created specifically for you transfers to your company — including source code, design files, and written content. We retain the right to use pre-existing components, frameworks, and tools we developed prior to or independently of your project.

We may showcase the work we've done for you in our portfolio and marketing materials unless you've signed an explicit NDA restricting this. We always respect confidentiality agreements — let us know if a project is under NDA.

8. Confidentiality and NDAs

We treat all client information as confidential by default. We're happy to sign a mutual NDA before sensitive discussions. For engagements involving sensitive data (e.g. PII, healthcare, financial records), a separate Data Processing Agreement (DPA) may be required and will be referenced in your service agreement.

9. Third-party services and dependencies

Some services rely on third-party platforms (e.g. AWS, OpenAI, Meta, HubSpot, Shopify). We're not responsible for outages, changes, or deprecations caused by these third parties. We'll notify you promptly of any issues affecting your services and work with you to find alternatives where possible. Third-party costs (e.g. API usage, ad spend, hosting) are billed at cost plus a reasonable management fee, transparently disclosed in your agreement.

10. Warranties and disclaimers

We warrant that our services will be performed in a professional and workmanlike manner consistent with industry standards. If you identify a defect in delivered work within 30 days of delivery, we'll fix it at no additional cost. This warranty does not cover: issues caused by client-provided materials, third-party changes, or modifications made by anyone other than MyAluxTech.

Except as expressly stated, our services are provided "as is" without warranties of any kind. We don't guarantee specific business outcomes (e.g. revenue, conversion rates, search rankings) though we work hard to deliver measurable results.

11. Limitation of liability

To the maximum extent permitted by law, MyAluxTech's total liability for any claim arising from our services is limited to the amount you've paid us for the specific service giving rise to the claim in the 6 months preceding the claim. We're not liable for indirect, incidental, consequential, or special damages, including loss of profits, data, or business interruption.

12. Cancellation and termination

Either party may terminate an engagement with 30 days' written notice. Upon termination, you're responsible for payment of work completed up to the termination date. We'll provide reasonable handover of materials, access, and documentation. Pre-paid retainers are non-refundable but unused time can typically be applied within 60 days of termination.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which MyAluxTech is registered, without regard to conflict-of-law principles. Any disputes will be resolved in the courts of that jurisdiction, unless we agree in writing to alternative dispute resolution (e.g. mediation or arbitration).

14. Changes to these terms

We may update these Terms from time to time. When we do, we'll revise the "last updated" date at the top of this page. For material changes affecting existing clients, we'll provide notice by email at least 30 days before the changes take effect.
